Cruise Ship Rape and Sexual Assault –Part I

Cruise ships offer fun for the whole family.  These floating vacation havens abound with pools, slides, parties, and more.  However, behind all these attractions and glee is the potential for danger.  Cruise ships bring together thousands of people in close quarters.  Cruise ship employees come from all different countries and walks of life, as to the passengers.  These conditions combine to present the risk of sexual assaults and rapes.  It is believed that hundreds of sexual assaults and rapes have occurred aboard cruise ships in the past few years.  Many sexual assaults go unreported and others are hidden from the public eye.

Liability for Cruise Ship Rapes

Cruise ship rapes and sexual assaults can be broken down into two categories:  those committed by employees and those committed by others. Many cruise ship sexual assaults involve cruise line employees, but some have occurred at the hands of other passengers or third parties.  In this segment, we discuss rapes perpetrated by non-employees.  We address employee rapes and sexual assaults in Part II of this two part look at cruise ship rapes and sexual assaults.

Rapes by Others

If a cruise ship passenger is raped by another passenger or third party, liability will depend upon whether the cruise line took proper measures to ensure the safety of passengers.  Specifically, the court will look to the cruise line’s security efforts.  The court may consider whether the cruise ship:

  • Installed security cameras
  • Employed adequate security staff
  • Lit public areas sufficiently
  • Monitored the activities of passengers and others aboard the ship

A seminal case concerning cruise ships, Kermarec v. Compagnie Generale, gave us the rule that cruise lines have the duty to provide reasonable care to their passengers.  This includes providing sufficient security to protect passengers from harm, whether that harm comes from outside or inside the cruise ship.

Compensation for Cruise Ship Sexual Assault Victims

Those sexually assaulted or raped on a cruise ship can seek compensation for their injuries.  Rape victims may experience serious physical injuries, post-traumatic stress disorder, lasting emotional trauma, and more.  Cruise ship accident victims may be eligible to receive compensation for their physical and emotional injuries.  All victims should seek legal assistance as soon as possible.  Cruise lines have stringent deadlines for filing an action and sexual assault victims must act fast to protect their legal rights.
